Terms & Conditions
Biobility.com
Last updated: September 2026
These Terms & Conditions apply to consumer purchases made through Biobility.com. Biobility.com is operated by Herba Trading AS. Mandatory consumer rights under applicable law take precedence over any conflicting provision in these Terms.
1. Seller
Seller: Herba Trading AS
Trading name: Biobility.com
Org. No.: 934 504 127
Address: Anthon Walles vei 25C, 1337 Sandvika, Norway
Email: hello@biobility.com
Telephone: +47 67 55 05 00
2. Customer
The customer is the person who places the order. Where the customer acts as a consumer, mandatory Norwegian consumer-protection legislation applies.
3. Orders and contract formation
When you place an order, you are responsible for checking that the order and contact details are correct. We will send an order confirmation by email. A binding purchase agreement is formed in accordance with applicable law and the checkout information presented to you.
If an obvious error has occurred in price, product information or availability, we will contact you as soon as reasonably possible. We will not substitute a different product without your agreement.
4. Product information
We aim to provide accurate descriptions, images, prices and availability information. Minor visual differences may occur, for example due to screen settings or packaging updates. Nothing in this clause limits your statutory rights where a product does not conform to the contract or information provided before purchase.
5. Prices, taxes and payment
Unless otherwise stated, prices for sales to Norwegian consumers are shown in NOK and include applicable VAT. Any delivery charges or other mandatory charges will be displayed before the order is submitted.
Available payment methods are shown at checkout and may include Visa, Mastercard and Vipps. Payment services may be provided by third-party payment providers, including providers such as Stripe and Vipps where enabled on the website.
Payment will be charged or reserved in accordance with the payment method, the checkout information and applicable law.
6. Delivery
We aim to dispatch orders promptly. Delivery method, estimated timing and any delivery charge will be shown or communicated as part of the order process where applicable. Available carriers may include Bring Servicepakke, PostNord, Porterbuddy, Helthjem and UPS.
If delivery is delayed, your rights are governed by applicable consumer law. Carrier delays or other circumstances outside our control do not remove mandatory rights you may have in relation to delayed or failed delivery.
For uncollected or undeliverable parcels, we may charge reasonable and documented costs caused by the return or a new shipment to the extent permitted by law. See our Shipping Policy for details.
7. Risk
For consumer purchases, risk in the goods passes in accordance with applicable consumer law. As a general rule, the seller bears the risk until the goods have been delivered to the consumer or a person designated by the consumer, subject to statutory exceptions.
8. Right of withdrawal
For qualifying distance purchases, consumers normally have a 14-day statutory right of withdrawal under the Norwegian Right of Withdrawal Act, subject to statutory conditions and exceptions. See our Returns & Refunds Policy and the withdrawal information provided in connection with your purchase.
The right of withdrawal is distinct from your rights if goods are defective or otherwise do not conform to the contract.
9. Defects and complaints
If goods are defective or do not conform to the purchase agreement, consumers have the remedies provided by the Norwegian Consumer Purchases Act and other applicable law. Depending on the circumstances, these may include repair or replacement, price reduction, termination of the purchase and/or damages.
A complaint must be made within a reasonable time after the defect was or should have been discovered. For consumer purchases, two months is always considered a sufficient period. The overall statutory complaint period is generally two years, or five years for goods intended to last substantially longer than two years under normal use.
For goods purchased on or after 1 January 2024, defects that become apparent during the first two years are generally presumed to have existed at delivery unless that presumption is incompatible with the nature of the goods or defect.
10. Delayed or failed delivery
If we fail to deliver in accordance with the agreement, the consumer may exercise the remedies available under applicable law, which may include withholding payment, requiring performance, terminating the purchase and claiming damages where the legal conditions are met.
11. Customer non-payment
If payment is not made when due, we may exercise the rights available under applicable law, including claiming statutory interest and lawful collection costs. We may withhold delivery where permitted.
12. Health and product information
Information on Biobility.com is provided for general product and informational purposes and is not a substitute for professional medical advice, diagnosis or treatment. Always follow product labels and instructions. Where you have a medical condition, use medication, are pregnant or breastfeeding, or have questions about whether a product is appropriate for you, seek advice from an appropriate healthcare professional.
Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.
13. Privacy and cookies
We process personal data as described in our Privacy Policy. Our use of cookies and similar technologies is described in our cookie information and consent interface. Non-essential tracking will be used only where the applicable legal requirements are met.
14. Intellectual property
Unless otherwise stated, website content such as text, graphics, branding and original images is owned by or licensed to Herba Trading AS and is protected by applicable intellectual-property law. This does not restrict lawful personal use of the website.
15. Complaints and dispute resolution
If you have a complaint, please contact us first at hello@biobility.com so that we can try to resolve the matter.
If a consumer dispute cannot be resolved directly, the consumer may be able to submit the matter for mediation to the Norwegian Consumer Authority (Forbrukertilsynet) and use other competent dispute-resolution or court procedures available under applicable law.
16. Governing law
These Terms are governed by Norwegian law, without depriving consumers of any mandatory protection that applies under the law of their country of residence where such protection cannot lawfully be waived.
17. Changes to these Terms
We may update these Terms for future purchases to reflect changes to our business, services or legal requirements. The version applicable to an order is the version presented or otherwise applicable when the order is placed, subject to mandatory law.
